After the Founding Fathers wrote the Constitution of the United States they quickly acted to amend that wonderful document and added 10 changes - those first changes known as “The Bill of Rights.”
They were placed in a particular order because the framers of the Constitution saw the Rights of citizens as important and some Rights are protected because the other Rights help the citizens to ward off the encroachments by a Federal Government. Remember always that the framers of our Constitution did not trust a strong Federal government.
The First Amendment guarantees our freedom of speech, assembly, the right to petition the government and freedom of the practice of our religious beliefs. The Second Amendment states that the Federal government shall make no law that infringes on our right to bear arms. The Third states that the Federal government can’t force us to house (quarter) troops in our homes.
The Fourth Amendment states , “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
Two weeks ago this Right was trampled upon by our Federal Government under the direction of the Department of Justice which answers to the resident of the Oval Office. A quote attributed to Benjamin Franklin warned that any people willing to sacrifice a little liberty for safety deserved neither.
Apparently the national mainstream press would rather talk about what the Donald is saying about Ted’s wife rather than doing their job of looking into just who the “Third Party” is that has unlocked the terrorists cellular phone for the investigation.
The FBI had asked and even went as far as asking the courts to order Apple to find a way to unlock the password protected information in a way that would not destroy the protected messages. I want the truth to come out and I certainly have zero regard for the terrorists; however, I do share the worries that Apple expressed about opening up this Pandora’s Box. Apple’s argument was simple. Once this key is developed the ability to unlock the other phones in America then would exist and that fact would place every single owner of a phone at risk of being monitored.
Before you shout out, “I have nothing to hide!” That isn’t the point. The point is that the government could use data against you. Nefarious people could hack that key and begin to use data against you. Frankly; with some of the recent Supreme Court decisions I have wondered if the government had threatened Chief Justice Roberts with revealing information he would rather keep quiet.
Getting back to the point of the “Third Party” that can now open up our password protected phones and computers. The Administration sure has been quiet who this “Third Party” happens to be. They tell us it isn’t a governmental agency but these are the same folks who promised that my health care costs would drop, that we could keep our doctors, and that they would be the most transparent administration in history.
The former Secretary of State has done everything she could to hide her actions regarding September 11, 2012 while serving as Secretary of State and the government squelched the investigation of Lois Lerner who lead the battle against conservative American’s Rights in the election process. If it isn’t a government agency then no warrant would be required.
What I fear is that the Administration uses “government-speak” to refer to the NSA now as a non-governmental agency and that the NSA which has been tracking all of our calls, and e-mails is the “Third Party.” If that is true, then the Federal Agencies knew they had the key but wanted the smoke screen of Apple to be able to perpetuate the lie that the NSA did not have the ability to read every message.
It is now being reported that many law enforcement agencies across this great country are asking the Department of Justice to use that “Third Party” key to look into the cell phones of other folks.
Most of us have nothing to hide. Any Federal Agent reading my email would love the jokes folks share and the rest of the stuff would cure their insomnia. However; you and I and everyone else in the United States are protected from these intrusions into our private lives by the Constitution. I trust the judgments of Madison, Franklin, Washington, and the others over the judgment of the former community organizer friend of Bill Ayers and George Soros.
George Orwell warned in his book “1984” which was written in 1948 that “Big Brother” was watching and listening. That prospect shocked and scared the American people. I shudder to think that 33 years after 1984 people are willing to give up their liberty for the sake of perceived security.
We would do well to heed Ben’s warning.
